The Housing Act 1985 allows the assignment of a secure tenancy to a person who would be entitled to succeed in the event of the tenant’s death. 

Such assignment counts as a succession and no further succession can be allowed.

Joint tenants cannot assign the tenancy from joint to sole to the name of one of the joint tenants. If you have a joint tenancy and you are seeking to change this to a sole tenancy, please complete a Change of Tenancy form. Please be aware that you may need to seek a Property Adjustment Order.   

Joint tenants may assign their tenancy to one qualifying family member.

Before requesting to assign your tenancy please seek legal advice.

Please be aware of the following:

  • you will no longer have security of tenure or any of the rights and protection that this provides;
  • if you intend to remain at the property with the assignee, you are vulnerable to being asked to leave at any time; and
  • you will need to make your own arrangements for future housing and may be considered intentionally homeless if you approach London Borough of Hounslow for alternative accommodation.
