I've received a PCN for a moving traffic contravention
A PCN issued for a moving traffic contravention under the London Local Authorities and Transport for London Act 2003 will always be served by post and will either be supported by CCTV footage or still images. The recipient has 14 days to pay at the discount, or if missed, a further 14 days to pay at the full charge. They also have 28 days from the date of service of the PCN to submit formal representations if they want to contest it. Should we receive those representations within the discount period, we will give them a further 14 days to pay at the discount should those representations be rejected. Any representations received at this stage are required by law to be considered by staff directly employed by the council.
If those representations are rejected a Notice of Rejection will be served on the person who made them, giving them 28 days to appeal to an independent adjudicator. Adjudicators are independent of the council, and their decision is binding on both parties (subject to the possibility of a review, at the adjudicator’s discretion). An adjudicator may award costs if they feel that either party has behaved frivolously, vexatiously or wholly unreasonably.
